N. sought legal aid in a cassation appeal against a police-court judgment. The cantonal court rejected the request, holding that in police matters an ex officio lawyer is only available if the prosecutor seeks a custodial sentence or the case raises particular difficulties. A mere attempt to obtain cassation of an otherwise unassailable judgment is insufficient, and the provision is not meant to support hopeless appeals.

3. N. a assorti son pourvoi d'une requête d'assistance judiciaire, qui doit toutefois être rejetée. Selon l'article 2 al.3 LAJA en effet, en matière pénale, le prévenu n'a droit à un avocat d'office, dans les causes de police, que si le ministère public requiert contre lui une peine privative de liberté, ou si sa cause présente des difficultés particulières, si ce n'est celle de tenter d'obtenir la cassation d'un jugement échappant à la critique. Or, le but de l'article 2 al. 3 in fine LAJA n'est certes pas d'encourager le dépôt de pourvois voués à l'échec.
