Resumo Omnilex

The cantonal court held that a dispute over an increase in a subsidized rent does not fall within the ordinary rent-contestation procedure before the regional conciliation authority. Because the dwelling had been financed with public assistance and the rent remained subject to administrative control, Art. 253b para. 3 CO excluded Arts. 269 ff. CO. The court therefore confirmed that the competent bodies for deciding on rent fixation and any further abatements based on the tenant’s personal and income situation are the cantonal housing office and, where applicable, the federal housing office.

Sumário Omnilex

Art. 253b al. 3 CO; exclusion of Arts. 269 ff. CO for subsidized dwellings subject to authority control; competence to fix rent and decide on further abatements. Where housing premises have been created with public support and the rent is administratively supervised, disputes concerning rent fixation or increase do not belong to the ordinary conciliation procedure under tenancy law. The special public-law housing-support regime prevails over the civil-law rent-contestation scheme (consid. 2). The determination of additional rent reductions in view of the tenant’s personal circumstances and income is an administrative matter within the competence of the cantonal housing office, respectively the federal housing office, according to the applicable federal and cantonal legislation.

Art. 253b al. 3 CO Art. 20 LAL Art. 42ss LCAP Art. 15 al. 2 LI-CO Art. 27 OLCAP Art. 10ss RAL

RJN 1997 p. 117

Whether the regional conciliation authority has jurisdiction over a dispute concerning an increase of subsidized rent.

Decisão extraída

No. Rent disputes under Arts. 269 ff. CO do not apply to dwellings built with public subsidies and subject to authority-controlled rent.

Fundamentação extraída

Under Art. 253b para. 3 CO, the ordinary rent-contestation rules are excluded where public support measures apply and the rent is supervised by an authority. The lease clauses showed the building was financed with public aid under the federal and cantonal housing-support legislation, so jurisdiction lay with the administrative housing authorities.

Questão jurídica principal

Which authority is competent to determine additional rent reductions based on the tenant's personal situation and income.

Decisão extraída

The cantonal housing office, together with the federal housing office where applicable, is competent.

Fundamentação extraída

The assessment of entitlement to further rent abatements under the housing-support statutes is governed by the relevant federal and cantonal administrative schemes, not by the conciliation authority.
