A curing period for defects in pleadings presupposes at least an incipient case-related reasoning; it serves to improve or supplement a deficient submission, but not to supply a wholly missing substantive justification ex post. Where the appeal contains no material engagement with the contested non-entry decision, there is nothing that can be remedied.

Im Rahmen eines Baubewilligungsverfahrens zeigte der Gemeinderat das Baugesuch u.a. dem Anstösser A an. Im übrigen lag das Baugesuch auf der Gemeindekanzlei öffentlich auf. Nach Ablauf der Auflagefrist reichte A dagegen eine Einsprache ein. Der Gemeinderat erteilte die Baubewilligung und trat auf die Einsprache von A zufolge Verspätung nicht ein. A zog diesen Entscheid ans Verwaltungsgericht weiter und machte geltend, das Bauvorhaben verletze materielle Bauvorschriften.

Das Verwaltungsgericht wies die Beschwerde mit folgender Begründung ab:

    • Die Vorinstanz ist auf die Einsprache zufolge Versäumnis der Frist nicht eingetreten. In der Verwaltungsgerichtsbeschwerde setzt sich A damit nicht einmal im Ansatz auseinander. Seine Ausführungen erschöpfen sich in einer materiellen Kritik an der Baubewilligung. Er bestreitet mit Recht insbesondere nicht, dass er die Baueinsprache verspätet eingereicht hatte. Bei dieser Ausgangslage ist es nicht zu beanstanden, dass der Gemeinderat auf die verspätete Einsprache von A nicht eingetreten ist (§ 107 Abs. 2 lit. e in Verbindung mit § 107 Abs. 3 VRG). Die Verwaltungsgerichtsbeschwerde ist folglich ohne Weiterungen als unbegründet abzuweisen.
    • Anzumerken bleibt, dass im vorliegenden Verfahren auch keine Nachfrist zur Verbesserung der Rechtsschrift im Sinne von § 135 Abs. 2 VRG zu gewähren war, denn eine Nachfrist kann nicht dazu dienen, überhaupt erst eine sachbezügliche Begründung nachzuliefern (Urteil der I. öffentlichrechtlichen Abteilung des Bundesgerichts vom 3.5.1996, publiziert in: ZBl 98/1997 S. 307ff.; ARGVP 1992 S. 65; ferner V-Urteil K. vom 22.7.1997). § 135 Abs. 2 VRG handelt von der Verbesserung oder Ergänzung einer Rechtsschrift. Damit eine Begründung überhaupt verbessert oder ergänzt werden kann, muss mindestens im Ansatz eine Minimalbegründung vorliegen. Fehlt eine sachbezügliche Begründung, d.h. setzt sich der Beschwerdeführer mit keinem Wort mit den Erwägungen des angefochtenen Nichteintretensentscheids auseinander, so ist nichts zu verbessern.
