A preliminary project under the cantonal agricultural ordinance binds the authorities only with respect to the spatial measures it contains. Given the long duration of the procedure and the need to preserve administrative discretion, a minor, objectively justified deviation from the preliminary project was allowed.

  1. Der Gemeinderat stellt in seinem Entscheid vom 17. Dezember 1998 ferner fest, dass die Umfahrung der Liegenschaft Oberfeld im Vorprojekt der Gesamtmelioration nicht enthalten gewesen sei.

Dies trifft insofern zu, als ursprünglich nur die Sanierung des Belags der umstrittenen Güterstrasse vorgesehen war. Die gleichzeitige Verlegung der Güterstrasse im Bereich der Liegenschaft Oberfeld war im Vorprojekt tatsächlich noch nicht enthalten. Beim Vorprojekt handelt es sich um ein Planungsinstrument, welches raumwirksame Massnahmen der Gesamtmelioration (Wegnetz, Grabennetz, Anlagen, Objekte) enthält (vgl. §§ 75 und 78 der Kantonalen Landwirtschaftsverordnung; LaV, SRL Nr. 903). Es bindet die Behörden, soweit sie sich mit diesen raumwirksamen Massnahmen befassen (§ 75 Abs. 5 LaV). Trotz Vorprojekt muss aber, insbesondere angesichts der langen Verfahrensdauer einer Gesamtmelioration, allen beteiligten Behörden der zur Erfüllung ihrer Aufgaben nötige Handlungsspielraum belassen bleiben. Wenn nun in Abweichung zum Vorprojekt der Gesamtmelioration nicht nur der Belag der fraglichen Güterstrasse saniert werden soll, sondern die Güterstrasse sachlich gerechtfertigt im Bereich der Liegenschaft Oberfeld auch geringfügig verlegt werden soll, handelt es sich um eine Massnahme, die in diesen Handlungsspielraum fällt. Den Instanzen der Gesamtmelioration kann hieraus kein Vorwurf gemacht werden.
