Unter der Herrschaft der alten, bis 31. Dezember 1994 geltenden ZPO war die Editionspflicht der Verwaltungsbehörden unter die Bestimmungen der Editionspflicht Dritter subsumiert, wobei es der Rechtsprechung überlassen blieb, die notwendigen Anpassungen und Konkretisierungen vorzunehmen (vgl. LGVE 1991 I Nr. 20). Die Regelung von § 155 ZPO wurde mit der Revision der Zivilprozessordnung neu eingeführt. Damit wurde erstmals das Zusammenwirken zwischen Zivilrechtspflege und Verwaltung normiert. Die Verwaltungsbehörde hat in Beachtung des Grundsatzes der Gewaltentrennung über die Vorlegung herausverlangter Urkunden zu entscheiden, wobei vor allem verwaltungsrechtliche Bestimmungen über das Amtsgeheimnis zu berücksichtigen sind. Aus den Materialien zur revidierten ZPO geht indes klar hervor, dass § 155 ZPO nur dann zur Anwendung kommt, wenn die Verwaltungsbehörde nicht selbst Partei in einem Zivilprozess ist. Andernfalls hat nicht die Verwaltungsbehörde, sondern der Richter zu entscheiden, welche Urkunden die Verwaltungsbehörde herauszugeben hat. In diesem Fall kommen § 152 in Verbindung mit § 160 (Recht zur Aussageverweigerung) und § 164 ZPO (Zeugnispflicht) zur Anwendung. Eine Verweigerung der Edition ist im Rahmen der Beweiswürdigung (§ 143 ZPO) zu berücksichtigen.
