Impartiality of the notary; duty to remain neutral after notarization: The notary must safeguard the interests of all parties to the transaction and act as a neutral intermediary. This duty does not cease with the execution of the public deed, but continues thereafter. Accordingly, the notary may not, in a subsequent dispute between the contracting parties, align himself unilaterally with one side and thereby assume a position akin to that of a judge.
Der Notar hat bei der Beurkundungstätigkeit die Interessen aller Vertragsparteien wahrzunehmen; er ist "Mann der Mitte" für beide Parteien. Dies gilt auch für die Zeit nach Abschluss des öffentlich beurkundeten Vertrages. Es geht nicht an, dass ein Notar nach Abschluss eines Grundstückkaufvertrages im Streit der Vertragsparteien einseitig für eine von ihnen Stellung bezieht und damit quasi eine "Richterstellung" einnimmt.
