The district court refused provisional registration of a construction lien. The cantonal appellate court upheld the recourse and ordered the provisional registration in favor of the claimant. In the costs section, it held that, subject to a different allocation in the main action, first-instance costs are borne by the claimant and party costs are set for the court deciding the merits; if no main action is brought, the appellate court decides costs definitively on request. It applied § 237 lit. a ZPO by analogy to federal provisional-measure proceedings falling within § 225 ZPO.
§ 237 lit. a ZPO analog; costs in provisional-measure proceedings under federal law and canton law; provisional building lien proceedings: Where the merits action is still pending, costs may be reserved for the main proceedings and party costs fixed for that court. If no main action is filed, the appellate court shall, on request, render a definitive cost decision. The analogous application of the cost rule is not confined to cantonal provisional measures under § 227 ZPO, but extends to federal-law proceedings within the scope of § 225 ZPO (consid. in the cost discussion).
Das Amtsgericht wies ein Gesuch um vorläufige Eintragung eines Bauhandwerkerpfandrechts ab. Das Obergericht hiess den dagegen erhobenen Rekurs gut und gab dem Antrag auf vorläufige Eintragung eines Bauhandwerkerpfandrechts zugunsten des Klägers statt. Im Kostenpunkt wurde folgendes ausgeführt:
Unter Vorbehalt einer andern Kostenverlegung im Hauptprozess werden vor erster Instanz die Gerichtskosten dem Kläger auferlegt und die Parteikosten wettgeschlagen. Die Parteikosten sind jedoch zuhanden des Gerichts, das über die Hauptsache entscheiden muss, bereits festzusetzen. Kommt es nicht zum Hauptprozess (z.B. bei Vergleich oder bei Verzicht auf Klageeinreichung), entscheidet das Obergericht auf Antrag einer Partei definitiv über den Kostenpunkt (vgl. LGVE 1987 I Nr. 42). Diese Kostenverlegung erfolgt in analoger Anwendung von § 237 lit. a ZPO, der nicht nur für die Kostenregelung in Verfahren vorsorglicher Massnahmen des kantonalen Rechts (§ 227 ZPO) gilt, sondern auch für solche des Bundesrechts, die in den Geltungsbereich von § 225 ZPO fallen.
