Im Rahmen eines Disziplinarverfahrens hatte sich die Aufsichtsbehörde mit dem notwendigen Inhalt der Grundstückbeschreibung im Grundstückkaufvertrag zu befassen. In diesem Zusammenhang wurde folgendes ausgeführt:

Nach der Literatur und Rechtsprechung unterliegen dem Beurkundungszwang zunächst alle objektiv wesentlichen Vertragspunkte, nämlich die für das Geschäft wesensnotwendigen Willenserklärungen. Dazu gehört bei Grundstückkaufverträgen u.a. der Kaufgegenstand. Die zur genügenden Kennzeichnung der Kaufsache dienenden Angaben müssen sich aus der öffentlichen Urkunde selber ergeben (Schmid Jörg, Die öffentliche Beurkundung von Schuldverträgen. Ausgewählte bundesrechtliche Probleme, Diss. Freiburg 1988, Rz 324, 330 und 332). Wird ein Grundstück gekauft, auf dem ein Gebäude erst erstellt oder fertiggestellt wird, ist das Kaufobjekt so zu umschreiben, dass es identifiziert werden kann (Leuenberger Christoph, Abschluss des Grundstückkaufvertrages, in: Der Grundstückkauf, St. Gallen 1989, Rz 117, 119 und 120 S. 76f.; Brückner Christian, Der Umfang des Formzwangs beim Grundstückkauf, in: ZBGR 75 [1994] S. 22/23; Verband bernischer Notare, Musterurkunden/611 Merkblatt über Grundstückbeschreibungen).

Aufgrund der aufgelegten Akten bildete Gegenstand des Kaufvertrages ein Grundstück mit Bauten. Aus der Beschreibung im Kaufvertrag ergeben sich allerdings bezüglich Bau und Überbauungsstadium keine Hinweise. Der Kaufpreis und die vertragliche Regelung der Gewährleistung sowie der Baubeschrieb des Kaufobjektes bei Übernahme lassen indes vermuten, dass es sich beim Kaufobjekt um ein Grundstück mit Baute handelt. Aufgrund der strengen Anforderungen an die Sorgfaltspflicht des Notars und der Tatsache, dass die Umschreibung des Kaufobjektes inklusive allfälliger darauf bestehender Bauten (in welchem Überbauungszustand sie sich dabei befinden, ist unerheblich) als objektiv wesentlicher Vertragspunkt zu beurteilen ist, hat Notar X. mit seiner Unterlassung gegen Vorschriften der öffentlichen Beurkundung verstossen. Im vorliegenden Fall hätte das Bestehen der Baute in der öffentlichen Urkunde enthalten sein müssen. Dies sieht u.a. auch § 17 BeurkV vor, wonach der Vertrag die Beschreibung laut Hauptbuchblatt, zu der auch die Gebäude gehören, zu enthalten hat. Entspricht diese nicht oder nicht mehr dem aktuellen Stand, so sind in der öffentlichen Urkunde die tatsächlichen Verhältnisse zu beurkunden, z.B. Wohnhaus Nr. .. oder im Bau begriffenes Einfamilienhaus Nr. .. usw.
