In a legal aid matter, only the plaintiff was summoned to the second hearing and she appeared with counsel. Zur zweiten Verhandlung im Verfahren um Erteilung der unentgeltlichen Rechtspflege war einzig die Klägerin vorgeladen. Sie wurde von ihrem Anwalt begleitet, obwohl die Verbeiständung durch einen Anwalt nicht erforderlich war (vgl. LGVE 1987 I Nr. 39 E. 3 lit.c). Die Teilnahme eines Anwalts am Vermittlungsverfahren ist fakultativ (§ 190 Abs. 1 ZPO); die Kosten dieser Verbeiständung werden nicht entschädigt (§ 190 Abs. 4 ZPO; vgl. LGVE 1988 I Nr. 33). Ersetzt werden immer nur die notwendigen Aufwendungen. Allgemein empfiehlt es sich für einen unentgeltlichen Rechtsbeistand, seinen Aufwand vor Eintreffen des obergerichtlichen Bestätigungsentscheides zu minimieren (Studer/Rüegg/Eiholzer, Der Luzerner Zivilprozess, N 2 zu § 134 ZPO).
