Der vorbehaltlose Rückzug der Klage stellt einen eigentlichen Klageverzicht dar, der materiellrechtlich in Rechtskraft erwächst und prozessual als Erledigungserklärung den gesamten Prozess beendet. Damit wird auch das Rechtsmittelverfahren gegenstandslos; der erstinstanzliche Entscheid verliert seine Grundlage. Eine Kostenfrage ist im Appellationsverfahren nicht mehr zu prüfen; ebenso setzt die Kostenbeschwerde nach § 5 KoG einen bestehenden, anfechtbaren Kostenentscheid voraus. Kosten sind nach § 119 Abs. 1 ZPO der unterliegenden bzw. zurückziehenden Partei aufzuerlegen. Bei der Kostenfestsetzung ist die Appellationsinstanz an die Vorinstanz nicht gebunden und kann tarifwidrige Festsetzungen von Amtes wegen berichtigen (§ 5 Abs. 3 KoG).

Aus den Erwägungen:

Die Kläger haben vorbehaltlos Rückzug der Klage erklärt und damit materiellrechtlich auf den im Prozess erhobenen Anspruch verzichtet. Es handelt sich somit um einen eigentlichen Klageverzicht, der in materielle Rechtskraft erwächst (§ 113 Abs. 3 ZPO). Der Prozessabstand (Klageverzicht, Klagerückzug, Klageanerkennung) ist eine prozessuale Willenserklärung, der ein Erledigungsentscheid folgt, mit dem der ganze Prozess beendet wird (§ 104 Abs. 3 ZPO). Bei dieser Sachlage fällt auch das Appellationsverfahren, das Teil des Zivilprozesses ist, als gegenstandslos dahin. Ein Klagerückzug (im weiteren Sinn) entzieht dem erstinstanzlichen Urteil wie auch dem Rechtsmittelprozess die Grundlage. Die von den Klägern aufgeworfene Kostenfrage kann deshalb nicht im Rahmen des Appellationsverfahrens geprüft werden. Ebensowenig kann der Kostenpunkt Gegenstand einer Kostenbeschwerde nach § 5 KoG sein. Denn dieses Rechtsmittel setzt den Bestand eines angefochtenen und zu überprüfenden Kostenentscheides voraus; ein solcher ist jedoch - wie erwähnt - durch die Erklärung des Klageverzichts hinfällig geworden.

Gemäss § 119 Abs. 1 ZPO werden der unterliegenden Partei die Prozesskosten auferlegt. Unter diese Bestimmung fällt auch eine Partei, die ihre Klage zurückzieht (Studer/Rüegg/Eiholzer, Der Luzerner Zivilprozess, N 1 zu § 119). Im vorliegenden Fall ist unbestritten, dass den Klägern die gesamten Prozesskosten zu überbinden sind. In der Festsetzung der Kosten freilich (Bestimmung des Kostenmasses) ist die Appellationsinstanz an die von der Vorinstanz getroffene Kostenregelung nicht gebunden. Dies liegt zum einen darin begründet, dass das Urteil des Amtsgerichts als aufgehoben gilt; zum andern ist auf § 5 Abs. 3 KoG hinzuweisen, wonach das Obergericht tarifwidrige Kostenfestsetzungen von Amtes wegen abändern kann. Die von den Klägern im Schreiben vom 8. August 1995 gerügte Kostenfestsetzung ist daher zu prüfen.
