The reason lies in the structural conflict of interest: the estate’s interests are not congruent with those of a single heir, and heirs may contest executor measures. Such a setup risks reciprocal legal action between the lawyers and may confer on one heir an impermissible informational advantage through access to the executor’s files.

Es versteht sich von selbst, dass die Interessen des Nachlasses bzw. der Erbengemeinschaft als ganzer grundsätzlich nicht identisch sind mit denjenigen eines einzelnen Erben. Die Interessenkollision zwischen dem Mandat des Willensvollstreckers einerseits und den Aufträgen einzelner Erben andererseits ist evident. So kann beispielsweise jeder Erbe gegen Entscheidungen oder beabsichtigte Massnahmen des Willensvollstreckers Beschwerde führen (vgl. Jost Arthur, Fragen aus dem Gebiete der Willensvollstreckung, in: Festgabe des Luzernischen Anwaltsverbandes zum Schweizerischen Anwaltstag 9./10.5.1953 in Luzern, S. 106 f.). Damit aber ist programmiert, dass der eine Anwalt gegebenenfalls gegen den anderen rechtlich vorzugehen hat, oder aber er verzichtet zum voraus und grundlegend auf solche Interventionsmöglichkeiten (vgl. auch Sterchi Martin, Komm. zum bernischen Fürsprecher-Gesetz, Bern 1992, N 6 zu Art. 13, wo eine Vertretung eines Erben gegen einen andern als unzulässig erachtet wird, wenn der Büropartner eine Liegenschaft der Erbengemeinschaft verwaltet). Der Willensvollstrecker, der mit dem Anwalt eines der Erben in Bürogemeinschaft arbeitet, verstösst somit nicht nur gegen das Unabhängigkeitsgebot, sondern auch gegen seine Pflicht zur grundsätzlichen Gleichbehandlung aller Erben, da er es dem einen Erben ermöglicht, in die Akten des Willensvollstreckers Einblick zu nehmen und dadurch einen Wissensvorsprung gegenüber dem/den andern Erben zu erlangen.
