Der Angeklagte beanstandet, dass das Kriminalgericht die Kaution von Fr. 5000.- mit den Verfahrenskosten verrechnet hat. Nicht er, sondern seine Mutter habe den Kautionsbetrag von Fr. 5000.- überwiesen, weshalb eine Verrechnung ausgeschlossen sei. Dieser Einwand ist aber für die Frage des späteren Rückerstattungsadressaten ohne Bedeutung. Für die Behörden ist allein massgebend, wer ihnen die Kaution geleistet hat; war es der Angeklagte, so steht einem allfälligen Dritten, der ihm den Betrag zur Verfügung gestellt hatte, ein Rückerstattungsanspruch dem Angeklagten gegenüber zu (ZR 78 [1979] Nr. 72 S. 170). Dass die Kaution auch aus dem Vermögen des Schuldners stammen muss, ist keine Voraussetzung für eine Verrechnung mit den diesem auferlegten Verfahrenskosten. Andernfalls käme das Institut der Verrechnung wohl kaum mehr zum Tragen, da diese durch die Einrede der Drittleistung regelmässig vereitelt werden könnte, womit Tür und Tor für rechtsmissbräuchliches Verhalten geöffnet wären. Anders verhält es sich lediglich dann, wenn ein Dritter die Kaution im eigenen Namen geleistet hat (ZR 78 [1979] Nr. 72 S. 170 linke Spalte). Dies wird indes von der Verteidigung vorliegend nicht behauptet. Vielmehr hat der Verteidiger in seinem Plädoyer ausgeführt, dass der Angeklagte die Kautionssumme sofort seiner Mutter zurückerstatten müsse.

Der Angeklagte rügt im weiteren die Auffassung des Kriminalgerichts, wonach die Kaution auch dann zur Deckung der Kosten verwendet werden dürfe, wenn die Haftgründe entfallen seien. Sodann beanstandet er, es fehle an der Verrechnungsvoraussetzung der Fälligkeit, da das Strafurteil noch nicht in Rechtskraft erwachsen sei. Diese Rügen gehen fehl. Die StPO enthält betreffend die Verwendung der Kaution keine ausdrückliche Regelung für den Fall, dass der Angeklagte sich den Strafbehörden nicht entzieht und schliesslich vor Gericht unter Kostenauflage schuldig gesprochen wird. Obligationenrechtlich gesehen besteht ein Grundsätzlicher Anspruch auf Rückerstattung. Da der Staat aber seinerseits Anspruch auf Bezahlung der dem Angeklagten urteilsmässig auferlegten Kosten hat, richtet sich die Verrechnung nach den gesetzlichen Bestimmungen des Obligationenrechts (Art. 120ff. OR). Das den Parteien schriftlich eröffnete Dispositiv vom 10. Dezember 1992 ist mit Zustellung rechtskräftig geworden (§ 231 Abs. 2 StPO). Sodann unterliegt die Sicherungshinterlegung nicht dem Verrechnungsverbot nach Art. 125 Ziff. 1 OR. Schliesslich kann mit Ausfällung des rechtskräftigen Urteils in Verbindung mit Art. 75 OR sofort die Bezahlung verlangt werden (vgl. ZR 78 [1979] Nr. 72 S. 170f.; vgl. auch SJZ 88 [1992] Nr. 13 S. 240). Nach dem Gesagten steht daher der Verrechnung der ge1eisteten Kaution von Fr. 5000.- mit den Verfahrenskosten nichts entgegen.
