Vor Obergericht wurde zur Qualität einer mittels Telefax übermittelten Schuldanerkennung geltend gemacht, beim fraglichen Schreiben handle es sich nicht um eine Schuldanerkennung, weil es mit Telefax übermittelt worden sei und damit gemäss Bundesgerichtspraxis nicht als unterschriebene Anerkennung gewertet werden dürfe.

Dazu wurde ausgeführt:

Das Bundesgericht hat zwar entschieden, dass eine per Telefax eingereichte Verwaltungsbeschwerde die Gültigkeitsvoraussetzung der eigenhändigen Unterschrift nicht erfülle (Pra 81, 1992, Nr. 26). Damit ist aber über die Qualität einer mittels Telefax übermittelten Schuldanerkennung als provisorischer Rechtsöffnungstitel nichts gesagt. Eine mittels Telefax übermittelte und unterzeichnete Schuldanerkennung stellt jedenfalls dann einen provisorischen Rechtsöffnungstitel im Sinne von Art. 82 SchKG dar, wenn deren Originalkonformität nicht bestritten ist (RJN 1989 S. 337/38). Vorliegend hat die Beklagte die Originalkonformität der am 20. Januar 1992 mittels Telefax überrnittelten Schuldanerkennung nicht bestritten, sondern sich nur ausdrücklich davon distanziert. Sie hat im übrigen auch nicht geltend gemacht, es handle sich um eine Fälschung. Im Sinne der zitierten Rechtsprechung ist die Schuldanerkennung vom 20. Januar 1992 somit als provisorischer Rechtsöffnungstitel im Sinne von Art. 82 SchKG beachtlich.
