Non-appealable evidence orders of the trial court are in principle not subject to immediate complaint; they are to be challenged, if at all, with the remedy against the final judgment. The rationale is that evidentiary rulings remain subject to reconsideration by the court and that the court determines the evidentiary issue conclusively only in the final decision. An isolated complaint is admissible only exceptionally where the order causes a legal disadvantage that cannot later be cured, or can be cured only with difficulty, by the remedies against the judgment (cf. LGVE 1982 I Nr. 28).

Beweisverfügungen des Amtsgerichtes sind, wenn sie - wie vorliegend - nicht rekurrabel sind, grundsätzlich mit dem gegen das Urteil zulässigen Rechtsmittel anzufechten. Die Begründung liegt darin, dass Beweisbeschlüsse vom Gericht in Wiedererwägung gezogen werden können und das Gericht erst im Endentscheid zum Beweis endgültig Stellung nimmt. Die Anfechtung einer einzelnen Beweisverfügung mit Beschwerde ist deshalb nur dann zulässig, wenn sie für die eine oder andere Partei einen Rechtsnachteil zur Folge hat, der später mit den gegen das Urteil zulässigen Rechtsmitteln nicht mehr oder nur mehr schwer behoben werden kann (LGVE 1982 I Nr. 28 mit Verweisen).
