Der Antrag der Staatsanwaltschaft an die Kriminal- und Anklagekommission gemäss § 138 Abs. 2 StPO wird praxisgemäss den Parteien nicht zugestellt, da sie im Rekurs resp. allenfalls in der Vernehmlassung ihren Standpunkt darlegen können. Sie erhalten den Antrag der Staatsanwaltschaft normalerweise als Beilage zum Entscheid der Kriminal- und Anklagekommission zur Orientierung zugestellt. Diese Praxis wurde im Urteil der I. Öffentlichrechtlichen Abteilung des Bundesgerichts vom 9. März 1998 (1P.670/1997/has) i. S. K.H. bezüglich einer zusätzlichen Stellungnahme der Staatsanwaltschaft ausdrücklich geschützt (S. 4 f.).
