Resumo

The court waived court costs in the legal-aid proceedings, including the review and appeal stages, because both parties were granted legal aid. However, it ordered the plaintiff to bear the opposing party's appeal attorney fees. The reason was that the plaintiff had failed to present and substantiate the wage garnishment, health-insurance premiums, outside meal costs, and the inability to generate side income from taxi driving before the first-instance judge, although this would have avoided the appeal. The promised proof of pension-fund payment was not submitted.

By contrast, pursuant to § 237 i.V.m. § 120 Abs. 1 ZPO, the party who failed to satisfy its duty of cooperation and substantiation in the first instance may be ordered to bear the opposing party's appeal attorney fees personally, especially where the decisive means of support could and should already have been asserted and proven earlier (consid. Für das UR-Verfahren einschliesslich Überprüfungs- und Rekursentscheid werden keine Gerichtskosten erhoben, weil beiden Parteien die unentgeltliche Rechtspflege gewährt wird (§ 237 i.V.m. § 119 Abs. 1 ZPO; vgl. Max. XII Nr. 322).

Indes rechtfertigt es sich, den Kläger die im Rekursverfahren entstandenen Anwaltskosten selbst tragen zu lassen (§ 237 i.V.m. § 120 Abs. 1 ZPO), weil er es versäumt hatte, die nunmehr für die UR-Erteilung massgebende Lohnpfändung bereits vor dem Amtsgerichtspräsidenten geltend zu machen und zu belegen (vgl. LGVE 1996 I Nr. 26 zur Mitwirkungs- und Begründungspflicht des UR-Gesuchstellers, mit Hinweis auf §§ 132 Abs. 3, 133 Abs. 3 i.V.m. §§ 230 Abs. 1 und 2 und 234 Abs. 3 ZPO; Urteil des Bundesgerichts vom 7.2.1996, 5P.482/1995/atm, i.S. R.S.; BGE 111 Ia 104 E. 2 lit. b). Immerhin wurde die Lohnpfändung rund zwei Monate vor dem vorinstanzlichen Entscheid verfügt, der im übrigen erst noch 1½ Monate später zugestellt worden ist. Gleiches gilt für den Nachweis der Krankenkassenprämie und die Kosten auswärtiger Verpflegung. Auch wäre es dem Kläger ohne weiteres möglich gewesen, dem Amtsgerichtspräsidenten mitzuteilen, dass er entgegen seinen Aussagen an der Instruktionsverhandlung vom 23. Februar 1996 noch keinen Nebenverdienst aus dem Taxifahren erzielen kann. Damit hätte sich ein Rekursverfahren erübrigt. Der im Rekursverfahren in Aussicht gestellte Auszahlungsbeleg der Pensionskasse wurde nicht nachgereicht.
