Resumo Omnilex

The cantonal administrative court dismissed a social assistance appeal against a municipal decision reducing the rent recognized for support purposes from CHF 1,295 to CHF 950 after a transition period ending on 31 March 2009. It held that the appellant had long known that her apartment exceeded the maximum rent, that the municipality had already acted generously with a transitional solution, and that excessive housing costs need only be covered until the next possible termination date, at most for six months. The court also noted that affordable housing existed in the municipality and that no move to another municipality was required. No court costs were imposed.

Sumário Omnilex

Art. 8 ABzUG; rent above the maximum recognized for social assistance purposes may be covered only until the next possible notice date, and in any event only for a limited transitional period not exceeding six months. A beneficiary cannot rely on indefinite assumption of excessive housing costs merely because no cheaper replacement accommodation is immediately available. Where the person concerned has long been aware of the over-maximum rent and the authority has granted a reasonable transition, the reduction of the acknowledged rent is lawful (consid. 2). Under Art. 48 and Art. 75 Abs. 2 VRG, the court may issue an unreasoned judgment and reduce or waive the court fee accordingly.

3. Kammer

URTEIL

vom 19. Februar 2009

in der verwaltungsrechtlichen Streitsache

betreffend öffentliche Unterstützung

Whether the municipality had to continue covering rent above the maximum amount until the appellant found a larger suitable flat in the municipality.

Decisão extraída

No. The appellant could not rely on unlimited coverage of the higher rent; the municipality was entitled to limit assistance after a reasonable transitional period.

Fundamentação extraída

The rental cap was introduced by municipal regulation, the excess rent had long been known, and the municipality had already granted a generous temporary extension. Under the support rules, excessive housing costs need only be covered until the next possible termination date, at most for six months; in the circumstances, the appellant could reasonably have terminated the lease and searched for cheaper housing.

Questão jurídica principal

Whether the transitional period and the new maximum rent amount were unlawful or unreasonable.

Decisão extraída

No. The transition until 31 March 2009 and the new maximum rent of CHF 950 were considered sufficient and unobjectionable.

Fundamentação extraída

The appellant had ample time to adjust, and the local housing market offered adequate affordable housing; a move to another municipality was not required.

Questão jurídica principal

Whether court costs should be charged despite dismissal of the complaint.

Decisão extraída

No court costs were levied because the court decided without a full written judgment.

Fundamentação extraída

When the judgment is issued without full reasons, the procedural law allows an appropriate reduction of the court fee; here, no court costs were imposed.
