vom 17. November 2009

in der verwaltungsrechtlichen Streitsache

betreffend Versicherungsleistungen nach KVG

1. Mit Eingabe vom 28. September 2009 an den Kranken- und Unfallversicherungsverein (KUV) … beanstandete … eine "rechtsmissbräuchliche Verfügung" vom 26. August 2009 betreffend einen Zahlungsbefehl über Krankenkassenprämien. Der KUV leitetet das Schreiben in der Folge an das Verwaltungsgericht zur Behandlung als allfällige Beschwerde weiter. Mit Schreiben vom 13. Oktober 2009 wurde der Versicherten mitgeteilt, dass aus ihrer Eingabe an die KUV … nicht hervorgehe, ob sie ein Verfahren von Verwaltungsgericht durchführen wolle. Im Weiteren genüge die Eingabe den Anforderungen von Art. 61 lit. b des Bundesgesetzes über den Allgemeinen Teil des Sozialversicherungsrechts (ATSG) nicht. Zudem seien der angefochtene Entscheid sowie die verfügbaren Beweismittel beizulegen. Der Versicherten wurde Gelegenheit eingeräumt, dem Gericht innert Beschwerdefrist mitzuteilen, ob sie ein Verfahren vor Verwaltungsgericht durchführen wolle und falls ja, sei die Eingabe innert Frist mit Sachverhaltsdarstellung sowie Antrag und Begründung wie der Entscheid abzuändern sei, zu ergänzen. Dies erfolgte mit dem Hinweis, dass bei unbenutztem Fristablauf auf das Rechtsmittel nicht eingetreten werde.

Das Gericht zieht in Erwägung:

1. Eine Beschwerde muss gemäss Art. 61 lit. b des Bundesgesetzes über den Allgemeinen Teil des Sozialversicherungsrechts (ATSG) eine gedrängte Darstellung des Sachverhaltes, ein Rechtsbegehren und eine kurze Begründung enthalten. Genügt sie diesen Anforderungen nicht, so setzt das Versicherungsgericht der Beschwerde führenden Person eine angemessene Frist zur Verbesserung und verbindet damit die Androhung, dass sonst auf die Beschwerde nicht eingetreten wird. Eine analoge Bestimmung enthält Art. 38 des Gesetzes über die Verwaltungsrechtspflege (VRG).

2. Vorliegend geht aus der Eingabe der Beschwerdeführerin nicht hervor, ob sie überhaupt ein Gerichtsverfahren einleiten will. Ebenso wenig wird der streitrelevante Sachverhalt oder eine rechtliche Begründung in nachvollziehbarer Weise dargelegt. Mit eingeschriebenem Brief vom 13. Oktober 2009 wurde die Beschwerdeführerin deshalb vom Gericht aufgefordert, ihre Eingabe innert der Beschwerdefrist zu verbessern, ansonsten darauf nicht eingetreten werden könne. Diese eingeschriebene Sendung hat die Beschwerdeführerin weder in Empfang genommen noch hat sie innert der gesetzten Frist sonstwie reagiert. Damit kann auf die Beschwerde nach dem unter E. 1. Gesagten nicht eingetreten werden. Es sind keine Kosten zu erheben.

Demnach erkennt das Gericht:

1. Auf die Beschwerde wird nicht eingetreten.

2. Es werden keine Kosten erhoben.
