The court held that Action patrimoine vivant satisfies the requirement of being an association of cantonal importance under LPMNS Art. 63. Its membership of roughly 850 persons from nearly all Geneva communes and its canton-wide activity were decisive. The court rejected the idea that the association must also meet a longevity criterion, since such a condition is not stated in the statute and cannot be introduced by interpretation merely by reference to other laws where it is expressly mentioned.

La qualité pour agir en tant qu' "association d'importance cantonale" au sens de la LPMNS doit être admise pour l'association "Action patrimoine vivant" qui compte environ 850 membres provenant de la quasi totalité des communes genevoises et qui est active sur tout le territoire du canton. Cette qualité ne saurait dépendre d'un critère de longévité, lequel n'a pas été expressément prévu dans la LPMNS, alors qu'il est mentionné dans d'autres lois, par exemple la LCI et la LDTR.
