The Federal Supreme Court held that Art. 53(2) LPP obliges the pension institution to have an expert determine periodically whether it can meet its obligations, but not necessarily every year. If the institution failed to carry out that review for a certain period while preparing dynamic actuarial balance sheets, there is no basis for requiring vested benefits to be calculated in a different static manner. Such a method is not imposed by the pension regulations or by the relevant provisions of the Code of Obligations. A 5% interest rate is normally used for static calculations, unlike dynamic actuarial valuations.

Wird die Vorsorgeeinrichtung in dynamischer Rechnung geführt, so besteht ohne ausdrückliche reglementarische oder gesetzliche Grundlage keine Verpflichtung, für die statische Freizügigkeitsberechnung andere Grundlagen als die üblicherweise massgebenden anzuwenden; namentlich ist der statische Zinssatz von 5 % grundsätzlich zulässig. Die Berücksichtigung künftiger Lohn-, Beitrags- und Rentenentwicklungen ist für eine bei Austritt auszurichtende Freizügigkeitsleistung sachwidrig (vgl. Erw. nicht näher bezeichnet).

"L'art. 53 al. 2 litt. a LPP institue l'obligation pour l'institution de prévoyance de charger un expert de déterminer périodiquement, et non pas annuellement, si l'institution offre en tout temps la garantie qu'elle peut remplir ses engagements. Dans l'hypothèse, réalisée en l'espèce, où l'institution n'a pas procédé à cette vérification durant une certaine période, se contentant par ailleurs d'établir des bilans techniques en situation dynamique, on ne voit pas pourquoi ni comment il faudrait qu'elle calcule les prestations de libre passage à l'aide de bases techniques différentes en situation statique, cette méthode n'étant imposée ni par le règlement ni par les dispositions pertinentes du code des obligations. Comme le relève la défenderesse, il est normal que le taux d'intérêts de 5 % soit utilisé en situation statique, et non en situation dynamique comme c'était le cas pour les expertises actuarielles, dans la mesure où le fait de prendre en compte l'évolution future des salaires, des cotisations et des rentes pour déterminer une prestation de libre passage versée au moment où un assuré quitte l'institution de prévoyance n'a pas de sens".
