Scarpa stopped advance maintenance payments after the debtor allegedly evaded enforcement by changing address, abandoning domicile, and leaving jobs that could be traced. The court held that such conduct amounts to self-created insolvency and justified ending the advances. The challenged cessation was therefore upheld.
LARPA.11; advance maintenance payments may be discontinued where the debtor has deliberately rendered himself insolvent by evasive conduct. Self-created insolvency is established not only by formal inability to pay, but also by conduct aimed at frustrating enforcement, such as repeated changes of address, abandonment of domicile, and termination of traceable employment. In such circumstances, the administering body is entitled to cease advances because the statutory purpose of temporary assistance no longer justifies continued payment.
