La contribution annuelle des propriétaires exploitants ou des locataires de vignes exigée par l'article 18 LVIT est une charge de préférence qui repose sur une base légale suffisante; elle n'est pas disproportionnée et ne viole pas le principe de la force dérogatoire du droit fédéral dès lors que l'ordonnance fédérale sur la viticulture et le placement des produits viticoles, du 23 décembre 1971 (le statut du vin), autorise les cantons à prendre des mesures protégeant la culture de la vigne. L'utilisation du fonds viticole par l'association des organisations viticoles genevoises (AOVG) respecte la LVIT, même si l'affectation des fonds à des campagnes politiques demeure critiquable. Face à la disparition de la fédération des viticulteurs, dont le préavis est requis préalablement à la fixation par le département de la contribution annuelle au fonds viticole cantonal (art. 19 LVIT), le département pouvait requérir le préavis de l'AOVG, laquelle peut assumer le rôle joué par la fédération des viticulteurs.
