The decision interprets the scholarship-law income threshold under Art. 22(2) LEE. The court holds that the cross-reference to Art. 18 LEE includes paragraph 2 of that provision as well. Accordingly, the family income is calculated by tripling the amount determined under Art. 18(1) and then adding any amount under Art. 18(2), rather than tripling the combined amounts of paragraphs 1 and 2. This method is required to preserve the legislator’s intent regarding the income limit.

Für die Ermittlung der dreifachen Einkommenslimite ist daher zunächst der nach Art. 18 Abs. 1 LEE ermittelte Betrag zu verdreifachen; anschliessend ist gegebenenfalls der in Art. 18 Abs. 2 LEE vorgesehene Zusatzbetrag hinzuzurechnen. Eine Multiplikation sämtlicher Beträge aus Abs. 1 und 2 mit dem Faktor drei widerspricht dem gesetzgeberischen Willen.

Résumé

Le renvoi de l'art. 22 al. 2 à l'art. 18 LEE porte également sur l'alinéa 2 de ce dernier article. En conséquence, pour calculer le triple de la limite du revenu, l'autorité ne peut se contenter de multiplier par 3 les revenus indiqués à l'alinéa 1. Pour respecter la volonté du législateur, il convient d'ajouter au triple du revenu de l'alinéa 1, les montants prévus à l'art. 18 al. 2. La détermination du revenu du groupe familial selon l'article 22 alinéa 2 LEE, qui renvoie à l'article 18 LEE, se fait en multipliant par trois le montant obtenu sur la base de l'article 18 alinéa 1 LEE, auquel on ajoute ensuite, cas échéant, l'un des montants de l'article 18 alinéa 2, et non pas en multipliant par trois l'ensemble des montants de l'article 18 alinéas 1 et 2 LEE.
