Résumé

La décision de l'OLS de fixer la date d'une modification (naissance d'un enfant) le premier jour du mois suivant l'annonce tardive de ce changement constitue une pénalité injustifiée. La loi retient comme élément déterminant la date de la modification, et non pas la date de l'annonce de celle-ci. La naissance d'un enfant, modifiant la composition du groupe familial, doit entraîner une reconsidération du taux d'effort et une suppression de la surtaxe à compter du premier jour du mois suivant cette modification (art. 11 al. 3 RLGL), et non pas dès le premier jour du mois suivant son annonce.
