Résumé

Le TA a confirmé la décision de destituer un avocat pour violations grossières et répétées des règles qui gouvernent l'exercice de la profession d'avocat, plus précisément pour avoir agi dans un dessein d'enrichissement personnel au détriment de clients fragilisés par des sinistres ou des atteintes à leur santé, pour avoir tenté de masquer ses errements par des manoeuvres dilatoires; pour avoir enfin usé de tous les artifices procéduraux pour empêcher l'instruction des faits qui lui sont reprochés. Recevabilité d'une demande de récusation non adressée au président de la juridiction (irrégularité formelle réparable; 98 LOJ). Rejet de cette demande, faute de griefs précis à l'encontre des cinq juges concernés et faute d'avoir invoqué ce moyen in liminie litis. Seules des erreurs de procédure particulièrement graves ou répétées, constitutives de violations des devoirs du magistrat, peuvent conduire à admettre une prévention de sa part, ce que ne démontre pas le recourant dans le cas d'espèce.
