Resumo Omnilex

The insured person challenged the fund's refusal to revise or reconsider its earlier decision, arguing that a later AI decision and its medical expert assessment showed a different view of work capacity. The court held that the later AI decision did not bind the fund and, by itself, did not justify revision. The mere existence of divergent expert opinions was not enough to show that the fund's decision was manifestly wrong. The appeal was therefore dismissed.

Sumário Omnilex

Art. 89b LPA; revision/reconsideration of an insurance decision based on later administrative assessments; a subsequent AI decision does not as such constitute a ground for revising the fund's decision. A later divergent assessment of work capacity by another authority is not binding on the fund. Divergence between medical experts, without more, does not establish manifest error or other revisional grounds. The court confirms that revision requires qualifying new facts or evidence, not merely a different appreciation of already known medical circumstances.

Whether a later AI decision and divergent work-capacity assessments justify revision or reconsideration of the fund's decision under Art. 89b LPA.

Decisão extraída

A subsequent AI decision does not constitute a ground for revising the fund's decision. A different assessment by the AI does not bind the fund, and the expert divergence does not show that the fund's decision was manifestly incorrect.

Fundamentação extraída

The AI decision was adopted later and reflects only a different appraisal of the claimant's work capacity. That disagreement between experts is insufficient to establish the kind of manifest error required for revision/reconsideration.
