The case concerned an association's challenge to the participation of a commission member appointed by the Executive Council in the consultative fishing commission, because the commission had to opine on an authorization request filed by that same association. The court held that the member did not have to recuse himself on that ground alone. It further held that a refusal to require an environmental impact study, even if insufficiently reasoned, could be remedied in the appeal proceedings before the Administrative Court. The appeal was dismissed.

Membership in an association that is itself the applicant does not, by itself, establish objective bias or a personal interest requiring disqualification where the body concerned merely issues an advisory opinion. A defect in the statement of reasons for refusing an environmental impact study may be cured in judicial review proceedings if the appeal authority can fully examine the matter and the party's procedural rights are thereby preserved.

Résumé

Un membre de l'association genevoise pour la protection de la nature nommé par le CE au sein de la commission consultative de la pêche n'a pas à se récuser au motif que cette commission est chargée de préaviser une demande d'autorisation déposée par cette association. Le refus d'une étude d'impact, si il constitue une violation de l'obligation de motiver les décisions, peut être réparé dans le cadre du recours au TA.
