An insured person sought treatment or compensation on the basis that shoulder lesions resulted from an accident. The court found no natural causal link between the alleged accident and the lesions. It further held that the condition could not be assimilated to an accident because it was shown to be the exclusive consequence of a pathological process that did not manifest itself through a sudden event. The claim was therefore rejected.

Art. 9 al. 2 LAA; natural causation and accident-equivalent injury: a lesion is not accident-related where the evidence shows that it derives exclusively from a pathological process. In such a case, the absence of a sudden triggering event excludes both natural causal linkage to an accident and assimilation to an accident under the statutory list of accident-equivalent injuries.
