Resumo

The Tribunal administratif dismissed the driver’s appeal against the SAN decision. After the driver lightly injured a pedestrian who was crossing on a safety crossing, the court confirmed the administrative measure withdrawing his category B license for four months and his category C license for two months. The court noted that the driver had no prior traffic offenses, but this did not lead to a reduction of the measure.

The absence of antecedents is a factor in assessing severity, but does not preclude maintenance of a four-month withdrawal for category B and a two-month withdrawal for category C when the traffic fault and its consequences are sufficiently serious.

Résumé

Confirmation d'une décision du SAN condamnant un chauffeur ayant légèrement blessé un piéton à l'épaule alors qu'il traversait la rue sur un passage de sécurité à 4 mois de retrait du permis B et 2 mois de retrait du permis C. Le chauffeur recourant n'avait pas d'antécédent en matière de circulation routière. Le Tribunal administratif a confirmé le retrait de quatre mois du permis B et de deux mois du permis C, à l'encontre d'un chauffeur ayant légèrement blessé un piéton, alors que celui-ci traversait la rue sur un passage de sécurité.
