Resumo

The Federal Criminal Court refused to approve the indictment in abbreviated proceedings against A. in a case concerning qualified economic intelligence, breach of trade secret and bank secrecy. It held that the matter could not proceed in abbreviated form and returned the file to the Federal Prosecution so that ordinary pre-trial proceedings could be conducted. The decision was declared final, with no appeal available under Art. 362 para. 3 sentence 3 StPO.

Art. 362 Abs. 3 StPO; refusal of approval of an indictment in abbreviated proceedings and consequences: If the court refuses to approve the indictment, the proceedings cannot continue in abbreviated form. The file must be returned to the prosecuting authority for conduct of ordinary proceedings. The refusal is not subject to appeal (consid. 1).

  • 2 - Die Strafkammer beschliesst:
  1. Die Genehmigung der Anklage im abgekürzten Verfahren gegen A. (SK.2013.27) wird abgelehnt.
  2. Die Sache wird zur Durchführung eines ordentlichen Vorverfahrens an die Bun- desanwaltschaft zurückgewiesen (Art. 362 Abs. 3 Satz 1 StPO).
  3. Dieser Entscheid wird den Parteien eröffnet (Art. 362 Abs. 3 Satz 2 StPO).
