Resumo Omnilex

The Federal Supreme Court dismissed the insured person's administrative-law appeal against the Zurich IV office's refusal of disability benefits, confirming the cantonal court's finding of full work capacity. It held that the medical evidence had been assessed in a coherent and non-arbitrary manner and that anticipatory weighing of evidence was permissible. To the extent the appellant argued that the IV office had breached duties to clarify and forward the matter to another insurer, the court declared the appeal inadmissible for lack of an appealable object. Court costs of CHF 500 were charged to the appellant.

Sumário Omnilex

Art. 61 lit. c ATSG; anticipatory assessment of evidence and scope of judicial review in disability insurance cases; an expert opinion need not be ordered where the record permits a conclusive and consistent evaluation of health status and work capacity. The court will uphold such fact-finding unless it is manifestly incorrect or based on a material procedural violation. Claims alleging breach of advisory or forwarding duties under Art. 37 Abs. 1 and 3 and Art. 30 ATSG are inadmissible in the absence of an appealable administrative object (Art. 78 Abs. 2 ATSG). Where the appeal is manifestly unfounded, it may be decided under Art. 36a OG; costs follow the outcome (Art. 156 Abs. 1 OG, Art. 135 OG).

Urteil vom 25. Juni 2007
II. sozialrechtliche Abteilung

Besetzung
Bundesrichter U. Meyer, Präsident,
Bundesrichter Lustenberger, Seiler,
Gerichtsschreiber Grunder.

Parteien
S.________, 1967, Beschwerdeführerin,
vertreten durch Rechtsanwalt Dr. Roland Ilg, Rämistrasse 5, 8001 Zürich,

gegen

IV-Stelle des Kantons Zürich, Röntgenstrasse 17, 8005 Zürich, Beschwerdegegnerin.

Gegenstand
Invalidenversicherung,

Juli 2006.

In Erwägung,

Whether the denial of an invalidity pension should be overturned and a full pension granted

Decisão extraída

The appeal failed because the cantonal court's assessment that the applicant remained fully capable of work was not manifestly incorrect and did not breach essential procedural rules.

Fundamentação extraída

The lower court's evaluation of the medical evidence was coherent and consistent; its anticipatory assessment of evidence was compatible with the inquisitorial principle, so no further clarification was required.

Questão jurídica principal

Whether a psychiatric expert opinion had to be ordered for further fact-finding

Decisão extraída

No further psychiatric expertise was required on the record as assessed by the lower court.

Fundamentação extraída

The file already permitted a conclusive assessment of health status and work capacity; the court accepted anticipatory weighing of the evidence.

Questão jurídica principal

Whether claims based on an alleged duty-to-inform and duty-to-forward breach by the IV office were admissible

Decisão extraída

The court did not enter into this part of the appeal because there was no appealable object.

Fundamentação extraída

To the extent liability was asserted for failure to clarify and forward the matter to another possibly competent social insurer, the complaint lacked a reviewable administrative decision.

Questão jurídica principal

How the costs of the federal proceedings should be allocated

Decisão extraída

Court costs were imposed on the appellant.

Fundamentação extraída

Costs followed the outcome of the proceedings.
