Resumo Omnilex

The Federal Supreme Court did not enter into the appellant's challenge against the Solothurn Social Insurance Court's judgment because the filing failed to meet the mandatory requirements of Art. 42 BGG. It did not engage with the cantonal reasoning and did not explain any erroneous factual findings or legal errors. The appeal was therefore disposed of in simplified proceedings under Art. 108(1)(b) BGG, and costs of CHF 300 were charged to the appellant.

Sumário Omnilex

Art. 42 Abs. 1 und 2 BGG; Art. 108 Abs. 1 lit. b BGG; form and reasoning requirements for a federal appeal. An appeal must contain relief sought and a reasoned argument showing in a concise manner how the challenged decision violates law. Mere filing without engagement with the lower court's reasoning does not satisfy the minimum requirements; if no arguable infringement is shown, the Court may refuse to enter in simplified proceedings. Where the appeal is manifestly inadmissible, costs are borne by the appellant under Art. 66 Abs. 1 and 3 BGG.

IV-Stelle des Kantons Solothurn,
Allmendweg 6, 4528 Zuchwil,
Beschwerdegegnerin.

Gegenstand
Invalidenversicherung,

Beschwerde gegen den Entscheid des Versicherungsgerichts des Kantons Solothurn
vom 19. Juli 2010.

in Erwägung,

Whether the appeal met the formal requirements of Art. 42 BGG

Decisão extraída

The appeal did not satisfy the minimum pleading requirements because it contained no adequate requests or reasoning and did not address the cantonal court's reasons.

Fundamentação extraída

A legal remedy must state requests and reasons; the filing failed to engage with the 15-page cantonal reasoning and did not show any incorrect factual findings under Art. 97(1) BGG or legal errors under Art. 95 BGG.

Questão jurídica principal

Whether the Federal Supreme Court could enter into the appeal in simplified proceedings

Decisão extraída

No entry was possible; the appeal was dismissed from the outset in simplified proceedings.

Fundamentação extraída

Because the appeal manifestly failed the statutory requirements, the Court applied Art. 108(1)(b) BGG and did not enter into the merits.
