Resumo Omnilex

The Federal Supreme Court held that the appellant’s filing against the Zurich Social Insurance Court decision was inadmissible because it contained neither a prayer for relief nor any substantive reasoning addressing the lower court’s decisive considerations. Despite being informed of the defects and that they could only be cured within the appeal period, the appellant filed no corrected appeal. The Court therefore issued a simplified non-entry decision. It also waived court costs, which rendered the pending request for free legal aid moot.

Sumário Omnilex

Art. 42 Abs. 1 und 2 BGG; Art. 108 Abs. 1 lit. b BGG; requirements of an appeal brief and simplified non-entry: an appeal must contain a request and a concise reasoning showing how the contested decision infringes the law. A filing that lacks a prayer for relief and does not engage, even minimally, with the decisive grounds of the lower court is manifestly deficient. If the appellant fails to remedy the notified formal defects within the appeal period, the court may decide in the simplified procedure not to enter into the matter. Where no court costs are charged under Art. 66 Abs. 1 in fine BGG, a request for legal aid becomes moot.

Urteil vom 25. September 2009
II. sozialrechtliche Abteilung

Besetzung
Bundesrichter U. Meyer, Präsident,
Gerichtsschreiber Ettlin.

Parteien
H.________,
Beschwerdeführer,

gegen

IV-Stelle des Kantons Zürich, Röntgenstrasse 17, 8087 Zürich,
Beschwerdegegnerin.

Gegenstand
Invalidenversicherung,

in Erwägung,
