Resumo Omnilex

The compensation office had withdrawn its 10 September 2007 contribution assessment while the company’s cantonal appeal was pending, and the Zurich Social Insurance Court therefore struck the case as moot. The company appealed to the Federal Supreme Court, but raised only issues concerning the personal contribution status of the partners and the qualification of income from another company. The Court held that these issues fell outside the scope of the challenged dismissal decision. It therefore declared the appeal inadmissible in simplified proceedings and waived court costs.

Sumário Omnilex

Art. 108 Abs. 1 lit. a BGG; scope of appeal against a cantonal dismissal for mootness. The Federal Supreme Court will not enter into an appeal where the submissions concern issues not encompassed by the dispute defined by the challenged decision. Review is limited to the object of the cantonal ruling; arguments directed at other, substantive contribution questions are inadmissible. Where an appeal is obviously inadmissible, it may be disposed of in simplified proceedings; court costs may be waived under Art. 66 Abs. 1 BGG.

Urteil vom 26. Juni 2008
II. sozialrechtliche Abteilung

Besetzung
Bundesrichter U. Meyer, Präsident,
Gerichtsschreiber Attinger.

Parteien
Firma H.________,
Beschwerdeführerin,

gegen

Ausgleichskasse des Kantons Zürich, Röntgenstrasse 17, 8005 Zürich,
Beschwerdegegnerin.

Gegenstand

April 2008.

In Erwägung,
