Resumo Omnilex

The claimant appealed to the Federal Supreme Court against the cantonal judgment concerning entitlement to an invalidity pension. He attacked the medical evidence, but the Court held that the expert report from the medical assessment institute complied with evidentiary standards and that the cantonal court had reasonably addressed the contrary medical opinions. The finding of 80% work capacity in suitable light work was binding. As the appellant merely reargued the evidence and did not challenge the remaining disability assessment, the appeal was obviously unfounded and was dismissed in simplified procedure. Court costs of CHF 500 were imposed on the appellant.

Sumário Omnilex

Art. 61 lit. c ATSG; Art. 95, 105 Abs. 1 und 2, 109 Abs. 2 lit. a and Abs. 3 BGG; probative value of medical expert reports and scope of review by the Federal Supreme Court. A medical expertise satisfies the requirements of evidentiary value if it is complete, comprehensible, based on proper examinations and reasoned conclusions; the mere existence of contrary treating-physician opinions does not remove its probative force, particularly where the lower court has duly dealt with them and the distinction between treatment and expert assessment is respected. Findings on work capacity are binding unless based on legal error or manifest factual error. A mere different appraisal of the file by the appellant is insufficient to establish a reviewable error.

Urteil vom 31. August 2009
II. sozialrechtliche Abteilung

Besetzung
Bundesrichter U. Meyer, Präsident,
Bundesrichter Seiler, Bundesrichterin Pfiffner Rauber,
Gerichtsschreiberin Dormann.

Parteien
M.________,
Beschwerdeführer,
vertreten durch Fürsprecher Dr. Michael Weissberg,

gegen

IV-Stelle Bern, Chutzenstrasse 10, 3007 Bern,
Beschwerdegegnerin.

Gegenstand
Invalidenversicherung (Invalidenrente),

In Erwägung,
BGE 124 I 170 E. 4 S. 175; Urteil 9C_801/2007 vom 7. Februar 2008 E. 3.2.2; Urteil 8C_286/2007 vom 3.

Whether the medical expert report had full probative value and whether the finding of 80% work capacity in adapted work could be reviewed.

Decisão extraída

The expert report met the federal requirements for evidentiary value, and the cantonal court was entitled to rely on it; the finding of 80% capacity was binding absent legal error or obvious inaccuracy.

Fundamentação extraída

The cantonal court dealt carefully with the contrary medical opinions, respected the distinction between treatment and expert assessment, and its factual finding was neither legally flawed nor manifestly incorrect under the Federal Supreme Court Act.

Questão jurídica principal

Whether the appeal against the denial of the disability pension was well founded.

Decisão extraída

The appeal was obviously unfounded and had to be dismissed in simplified procedure.

Fundamentação extraída

The appellant merely offered a different assessment of the medical records without demonstrating a reviewable error; the remaining invalidity assessment was not challenged.

Questão jurídica principal
