Resumo Omnilex

The insured person challenged a cantonal health insurance judgment before the Federal Supreme Court. The appeal was filed shortly before the deadline but did not explain in a legally sufficient manner why the factual findings were wrong or the legal assessment was unlawful. The court therefore declined to enter into the appeal in simplified procedure. It waived court costs, which made the request for free legal aid moot; the request for free legal representation likewise failed because no further procedural acts requiring counsel remained.

Sumário Omnilex

Art. 42 Abs. 1 und 2 BGG; Art. 97 Abs. 1 BGG; Art. 108 Abs. 1 lit. b und Abs. 2 BGG; requirements for admissibility of a federal appeal. A submission must state the relief sought and, in concise form, why the challenged decision violates law; mere unsubstantiated or vague criticism is insufficient. Where factual findings are attacked, the appellant must show qualified incorrectness, i.e. arbitrariness or manifest unacceptability, and the resulting legal error. If these minimum requirements are not met, the court may decline to enter in simplified procedure. A waiver of costs under Art. 66 Abs. 1 second sentence BGG renders a request for free legal aid moot; free legal representation presupposes procedural acts requiring legal assistance.

Urteil vom 21. Mai 2013
II. sozialrechtliche Abteilung

Besetzung
Bundesrichter Meyer, als Einzelrichter,
Gerichtsschreiber R. Widmer.

Verfahrensbeteiligte

vertreten durch SWICA Krankenversicherung AG, c/o SWICA Gesundheitsorganisation, Boulevard de Grancy 39, 1001 Lausanne,
Beschwerdegegnerin.

Gegenstand
Krankenversicherung,

in Erwägung,

Whether the appeal met the minimum reasoning requirements under Art. 42 BGG and Art. 97 BGG

Decisão extraída

The appeal did not satisfy the statutory reasoning requirements because it failed to explain in a legally sufficient way why the factual findings were allegedly incorrect or the legal reasoning unlawful.

Fundamentação extraída

The submission contained a request, but its vague and unspecific arguments did not show any qualified incorrectness of the factual findings or any legal error in the challenged judgment.

Questão jurídica principal

Whether the appeal could be entered into in simplified procedure under Art. 108 BGG

Decisão extraída

The court had to refuse entry on the appeal in simplified procedure.

Fundamentação extraída

Because the appeal manifestly failed to meet the content requirements, non-entry was appropriate under Art. 108(1)(b) and (2) BGG.

Questão jurídica principal

Whether court costs should be charged

Decisão extraída

No court costs were levied.

Fundamentação extraída

The Federal Supreme Court waived costs under Art. 66(1) second sentence BGG.

Questão jurídica principal

Whether the requests for free legal aid and free legal representation became moot

Decisão extraída

The request for free legal aid and the request for free legal representation were moot or could not be granted as the appeal required no further procedural acts and the late, unsigned filing left no need for counsel.

Fundamentação extraída

After filing the appeal, the insured person had no further procedural steps to take that would have required legal assistance; the appeal was also submitted shortly before expiry of the deadline and not personally signed.
