Resumo Omnilex

The Federal Supreme Court found that the appeal against the Zurich Social Insurance Court’s decision did not satisfy the minimum requirements of Art. 42 BGG. The appellant failed to address the cantonal reasoning and did not show any erroneous factual findings or unlawful refusal/delay of justice. In simplified procedure, the court therefore did not enter into the appeal and exceptionally waived court costs.

Sumário Omnilex

Art. 42 Abs. 1 und 2 BGG; Art. 97 Abs. 1 BGG; Art. 108 Abs. 1 lit. b und Abs. 2 BGG; non-entry for insufficiently reasoned appeal. An appeal must set out concisely in what respect the challenged decision violates law; a merely formal request without substantive engagement with the decisive reasons is insufficient. Where the appellant fails to address the lower court’s reasoning and does not show, on the basis of the contested findings, why they are erroneous, the Federal Supreme Court may decline to enter into the matter in simplified procedure. Exceptional waiver of court costs is possible under Art. 66 Abs. 1 second sentence BGG.

Urteil vom 4. April 2014

II. sozialrechtliche Abteilung

Besetzung
Bundesrichter Meyer, als Einzelrichter,
Gerichtsschreiber R. Widmer.

Verfahrensbeteiligte
Z.________,
Beschwerdeführer,

gegen

Amt für Zusatzleistungen zur AHV/IV, Molkenstrasse 5/9, 8004 Zürich,
Beschwerdegegner.

Gegenstand

Februar 2014,

in Erwägung,
