The Federal Supreme Court held that the complaint in a disability insurance matter was filed well after the statutory deadline and that the defect was obvious to counsel. Because the appeal was manifestly tardy and vexatious, the Court, in simplified proceedings, did not enter into the matter. It waived court costs in view of the circumstances but imposed an order fine of CHF 300 on the appellant’s lawyer for again filing a vexatious complaint despite prior warnings.
Art. 100 Abs. 1, Art. 108 Abs. 1 lit. a, Art. 66 Abs. 2 and Art. 33 Abs. 2 BGG; late filing and vexatious appeal: a complaint lodged after expiry of the statutory appeal period is inadmissible where the lateness is evident and counsel should readily recognize it. In such a case the Federal Supreme Court may decline to enter into the matter in simplified proceedings. Where the circumstances so warrant, court costs may be waived; however, counsel may be sanctioned with an order fine if, despite repeated warnings, he again files a manifestly abusive appeal (consid. 1).

Nach Einsicht
in die Eingabe vom 22. Oktober 2011 (Poststempel) gegen die gemäss postamtlicher Bescheinigung am 21. Februar 2011 an die Postzustelladresse von J.________ ausgehändigte Verfügung des Bundesverwaltungsgerichts vom 17. Februar 2011,
in Erwägung,
dass die Beschwerde nicht innert der nach Art. 100 Abs. 1 BGG 30-tägigen, gemäss Art. 44 - 48 BGG am 23. März 2011 abgelaufenen Rechtsmittelfrist eingereicht worden ist,
dass dieser Mangel offenkundig ist und für den Rechtsvertreter leicht erkennbar gewesen wäre,
dass er überdies den angefochtenen Entscheid trotz Kenntnis der Beibringungspflicht nicht eingereicht hat,
dass deshalb auf die mutwillig erhobene Beschwerde im vereinfachten Verfahren nach Art. 108 Abs. 1 lit. a BGG nicht einzutreten ist,
dass umständehalber gestützt auf Art. 66 Abs. 2 BGG keine Gerichtskosten erhoben werden,
dass aber dem Rechtsvertreter in Anwendung von Art. 33 Abs. 2 BGG eine Ordnungsbusse von Fr. 300.- aufzuerlegen ist, da er trotz verschiedener Ermahnungen des Gerichts erneut mutwillig eine Beschwerde einreicht (dazu siehe die Urteile 9C_626/2011 vom 30. September 2011, 8C_169_2011, 8C_165/2011 8C_146/2011, alle vom 11. März 2011, mit weiteren Hinweisen),
erkennt der Präsident:

Auf die Beschwerde wird nicht eingetreten.
2.
Es werden keine Gerichtskosten erhoben.
3.
Rechtsanwalt Franklin Sedaj wird mit einer Ordnungsbusse von Fr. 300.- belegt.
4.
Dieses Urteil wird den Parteien, dem Bundesverwaltungsgericht und dem Bundesamt für Sozialversicherungen schriftlich mitgeteilt.

The complaint was filed out of time, as the 30-day period had expired on 2011-03-23 and the filing was only made on 2011-10-22.
The service date and the applicable time limits under the BGG made the lateness obvious.
