Resumo Omnilex

P. appealed a Federal Administrative Court decision in disability insurance matters to the Federal Supreme Court. The Court found the appeal inadmissible because the missing copy of the challenged decision was not submitted within the grace period and the appeal also failed to comply with the formal requirements of the Federal Supreme Court Act. The Court therefore issued a simplified non-entry decision. Exceptionally, no court costs were imposed.

Sumário Omnilex

Art. 42 Abs. 1, 2 und 5 BGG; Art. 108 Abs. 1 lit. a und b BGG; non-entry for uncured formal defects. Where the Court points out a curable formal defect and grants a grace period, failure to cure the defect within that period renders the appeal inadmissible. Independently, an appeal that manifestly does not meet the statutory requirements of reasoning and form is not entered into in simplified proceedings. If the case falls under Art. 108 Abs. 1 BGG, the division president is competent. Costs may exceptionally be waived under Art. 66 Abs. 1 second sentence BGG.

Urteil vom 6. November 2009
I. sozialrechtliche Abteilung

Besetzung
Bundesrichter Ursprung, Präsident,
Gerichtsschreiber Batz.

Parteien
P.________,
Kroatien,
Beschwerdeführer,

gegen

Unbekannt,
Beschwerdegegner.

Gegenstand
Invalidenversicherung (Prozessvoraussetzung),

Beschwerde gegen einen Entscheid des Bundesverwaltungsgerichts.

Nach Einsicht
in die Beschwerde des P.________ vom 7. September 2009 (Poststempel) gegen einen Entscheid des Bundesverwaltungsgerichts,

in Erwägung,

Whether the appeal was admissible despite the missing attachment and other formal defects

Decisão extraída

The appeal was inadmissible because the appellant did not remedy the missing attachment within the set grace period and the filing also manifestly failed to meet the formal requirements.

Fundamentação extraída

The Court had indicated the defect under Art. 42(5) BGG and granted a grace period, which expired without correction. In addition, the appeal did not satisfy Arts. 42(1) and (2) BGG, and no corrective submission was filed despite notice that the defect could still be cured within the appeal period.

Questão jurídica principal

Whether court costs should be charged

Decisão extraída

No court costs were imposed exceptionally.

Fundamentação extraída

Under Art. 66(1) second sentence BGG, the Court waived costs in this case.
