Resumo Omnilex

The appellant challenged the ETH Appeals Commission’s 2004 decision on termination of her public employment before the Federal Supreme Court. The court held that the appeal in public law matters was not admissible against that decision because Art. 86(1) BGG allows such appeals only against decisions of the Federal Administrative Court or final cantonal instances. Applying the simplified procedure, the President declined to enter into the appeal. The court also waived court costs.

Sumário Omnilex

Art. 86 Abs. 1 BGG; admissibility of the appeal in public law matters against decisions of the ETH Appeals Commission. The remedy is limited to decisions of the Federal Administrative Court or final cantonal instances; where the challenged decision does not satisfy that requirement, the Federal Supreme Court does not enter into the appeal in simplified procedure under Art. 108 Abs. 1 lit. a BGG in conjunction with Art. 30 Abs. 1 BGG. Costs may be waived under Art. 66 Abs. 1 second sentence BGG.

Questão jurídica principal

Whether the appeal in public law matters was admissible against the ETH Appeals Commission’s decision on termination of public employment.

Decisão extraída

The appeal was inadmissible because such an appeal is only available against decisions of the Federal Administrative Court or final cantonal instances, not against the ETH Appeals Commission in this procedural setting.

Fundamentação extraída

Art. 86(1) BGG limited admissibility to decisions of the Federal Administrative Court or final cantonal courts; the challenged decision did not meet that requirement, so the court declined to enter into the matter under the simplified procedure.

Questão jurídica principal

Whether court costs should be charged despite the non-entry decision.

Decisão extraída

No court costs were levied.

Fundamentação extraída

The court expressly waived costs under Art. 66(1) second sentence BGG.
