Resumo Omnilex

The insured person sought continued SUVA benefits after reporting a relapse from a 2000 bicycle accident, as well as a review of entitlement to a pension and integrity compensation. SUVA denied liability, and the cantonal social insurance court upheld that denial. The Federal Court, proceeding under Article 109 BGG, held that the lower court had correctly found no proven causal link between the accident and the later complaints. The complaint was therefore dismissed as manifestly unfounded, and court costs of CHF 500 were charged to the appellant.

Sumário Omnilex

Art. 109 BGG; accident insurance relapse and causal link; where the cantonal court has thoroughly assessed the file and convincingly denied the requisite natural and adequate causal connection between an earlier accident and later complaints, the Federal Court will not interfere if the appellant's objections and medical reports do not cast doubt on that assessment. Additional evidentiary supplementation may be refused when the existing record is sufficient. In manifestly unfounded cases decided under Art. 109 BGG, the complaint is dismissed and costs are allocated according to Art. 66 Abs. 1 BGG.

Besetzung
Bundesrichter Ursprung, Präsident,
Bundesrichterin Widmer, Bundesrichter Schön,
Gerichtsschreiber Batz.

Parteien
S.________, Beschwerdeführer, vertreten durch Beratungsstelle für Ausländer, Schützengasse 7, 8001 Zürich,

gegen

Schweizerische Unfallversicherungsanstalt (SUVA), Fluhmattstrasse 1, 6004 Luzern, Beschwerdegegnerin.

Gegenstand
Unfallversicherung,

Januar 2007.

In Erwägung,

Whether the 2004 relapse complaints were causally linked to the 2000 accident so as to trigger further SUVA benefits, including review of pension and integrity compensation.

Decisão extraída

The alleged accident causality was not established; SUVA had no further duty to pay benefits.

Fundamentação extraída

The cantonal court had carefully assessed the entire file and correctly concluded that the required causal link for the relapse complaints was lacking. The federal appeal and submitted medical reports did not undermine that assessment, and additional file supplementation was unnecessary.

Questão jurídica principal

Whether the appellant was entitled to have the case further investigated before a merits decision.

Decisão extraída

No additional evidentiary supplementation was required.

Fundamentação extraída

The requested supplementation was not needed in light of the already sufficient record and the prior court's thorough assessment.

Questão jurídica principal

Allocation of court costs in the federal proceedings.

Decisão extraída

Court costs were imposed on the appellant and set off against the advance payment.

Fundamentação extraída

Because the complaint was manifestly unfounded and decided under Article 109 BGG, the costs followed the outcome.
