Resumo Omnilex

The Federal Supreme Court held that the appeal against the Federal Administrative Court's non-entry decision in an invalidity insurance case was inadmissible because the appellant did not challenge the admissibility reasoning and merely repeated his prior substantive arguments. In the simplified procedure, the appeal was not entered into and the appellant was ordered to pay court costs of CHF 200.

Sumário Omnilex

Art. 42 Abs. 1 und 2 BGG, Art. 108 Abs. 1 lit. b BGG; requirements for an appeal against a non-entry decision. An appeal must set out, in concise form, why the challenged decision violates law. Where the lower court has not entered into the merits, submissions addressing only the substantive dispute do not constitute sufficient reasoning; the appellant must specifically engage with the non-entry grounds. Failure to do so justifies non-entry in simplified procedure. Cost allocation follows Art. 66 Abs. 1 and 3 BGG.

Urteil vom 26. Januar 2010
I. sozialrechtliche Abteilung

Besetzung
Bundesrichter Ursprung, Präsident,
Gerichtsschreiber Grünvogel.

Parteien
M.________,
vertreten durch Advokat Dejan Rakovic,
Beschwerdeführer,

gegen

IV-Stelle für Versicherte im Ausland,
Avenue Edmond-Vaucher 18, 1203 Genf,
Beschwerdegegnerin.

Gegenstand
Invalidenversicherung (Prozessvoraussetzung),

Beschwerde gegen den Entscheid des Bundesverwaltungsgerichts vom 24. November 2009.

November 2009,

in Erwägung,

Whether the appeal complied with Art. 42 BGG's reasoning requirements against a non-entry decision.

Decisão extraída

No. The appeal did not explain why the lower court should have entered into the case and merely repeated prior submissions.

Fundamentação extraída

An appeal must state requests and reasons in concise form. Against a non-entry decision, an argument addressing only the merits is not sufficient; the appellant failed to provide case-specific reasoning on admissibility.

Questão jurídica principal

Allocation of court costs after inadmissibility.

Decisão extraída

The appellant must bear court costs.

Fundamentação extraída

Under Art. 66 BGG, the unsuccessful party bears costs; the simplified inadmissibility procedure did not justify a different allocation.
