Resumo Omnilex

The appellant challenged the cost statement in two mortgage-enforcement cases after the Bern supervisory authority had rejected his complaint. Before the Federal Supreme Court he filed written notices and an emailed supplement, sought a new review method based on vouchers, and argued that the costs were excessive. The Court held that the new request was inadmissible because it had not been raised below, and that the complaint did not sufficiently identify the violated federal rules or engage with the cantonal reasoning. It therefore did not enter into the complaint. The Court also noted that the proceedings are free of charge and no party compensation is payable.

Sumário Omnilex

Art. 79 Abs. 1 OG; Art. 30 Abs. 1 OG; requirement of substantiated federal complaint and ban on new requests in federal debt-enforcement complaints: A complainant must specify which federal provisions were violated and in what respect; a mere general criticism of the amount of costs is insufficient. Requests not raised despite the opportunity to do so in the cantonal proceedings are inadmissible in federal complaint proceedings. Whether an emailed, unsigned supplement satisfies the formal requirements of a written submission may remain open if the complaint is inadmissible for lack of proper reasoning and because it contains impermissible new conclusions (consid. 1).

Besetzung
Bundesrichterin Escher, Präsidentin,
Bundesrichterin Hohl, Bundesrichter Marazzi
Gerichtsschreiberin Scholl.

Parteien
Z.________,
Beschwerdeführer,

gegen

Aufsichtsbehörde in Betreibungs- und Konkurssachen für den Kanton Bern, Hochschulstrasse 17, Postfach 7475, 3001 Bern.

Gegenstand
Verteilungsliste/Kostenrechnung,

SchKG-Beschwerde gegen den Entscheid der Aufsichtsbehörde in Betreibungs- und Konkurssachen für den Kanton Bern vom 13. Juli 2004.

Die Kammer hat nach Einsicht
in den Entscheid der Aufsichtsbehörde in Betreibungs- und Konkurssachen für den Kanton Bern vom 13. Juli 2004, mit welchem die Aufsichtsbehörde eine Beschwerde von Z.________ betreffend die Kostenrechnung des Betreibungs- und Konkursamtes Berner Oberland, Dienststelle Interlaken, in den Betreibungen auf Grundpfandverwertung Nr. xxx und Nr. yyy abgewiesen hat, soweit sie darauf eingetreten ist;
in zwei Schreiben vom 31. Juli 2004, in welchen Z.________ (ohne Begründung) erklärt, gegen obigen Entscheid Beschwerde zu erheben;
in die per E-mail bei der Aufsichtsbehörde eingegangene Beschwerdebegründung vom 2. August 2004;

in Erwägung,
dass offen bleiben kann, ob die per E-mail eingereichte (nicht eigenhändig unterschriebene) Beschwerdeergänzung die Anforderungen von Art. 30 Abs. 1 OG an die Form einer Rechtsschrift erfüllt;
dass nach Art. 79 Abs. 1 OG neue Begehren nicht anbringen kann, wer dazu im kantonalen Verfahren Gelegenheit hatte;
dass daher der (neue) Antrag des Beschwerdeführers, die Auslagen des Betreibungsamtes anhand von Belegen und nicht anhand des Journals zu überprüfen, unzulässig ist;
dass nach Art. 79 Abs. 1 OG in der Beschwerdeschrift zudem kurz darzulegen ist, welche Bundesrechtssätze und inwiefern diese durch den angefochtenen Entscheid verletzt worden sind (BGE 119 III 49 E. 1 S. 50);
dass die Aufsichtsbehörde im Wesentlichen ausgeführt hat, der Beschwerdeführer erachte die Höhe der Kosten als übersetzt, zeige jedoch nicht auf, mit welchen Kosten er konkret nicht einverstanden sei;
dass sich der Beschwerdeführer nur ungenügend mit diesen Erwägungen auseinander setzt und insbesondere nicht nachweist, dass er bereits im kantonalen Verfahren die Begründungsanforderungen erfüllt hat;
dass damit auf die Beschwerde insgesamt nicht eingetreten werden kann;
dass das Beschwerdeverfahren grundsätzlich kostenlos ist (Art. 20a Abs. 1 SchKG) und keine Parteientschädigung zugesprochen werden darf (Art. 62 Abs. 2 GebV SchKG);

erkannt:
1.
Auf die Beschwerde wird nicht eingetreten.
2.

Whether the emailed supplement to the complaint met the formal requirements of a written submission.

Decisão extraída

The court left this open, because the complaint was inadmissible in any event.

Fundamentação extraída

The court did not need to decide whether an unsigned emailed supplement satisfied the formal requirements of Art. 30(1) OG.

Questão jurídica principal

Whether the appellant could raise a new request to verify the office expenses by vouchers rather than by the journal.

Decisão extraída

No. A party may not introduce new requests in the federal complaint if it had the opportunity to do so in the cantonal proceedings.

Fundamentação extraída

Under Art. 79(1) OG, new prayers for relief are barred when they could have been raised below; this request was therefore inadmissible.

Questão jurídica principal

Whether the complaint sufficiently identified which federal-law rules were violated and how.

Decisão extraída

No. The complaint did not meet the reasoning requirement.

Fundamentação extraída

The appellant did not engage adequately with the supervisory authority's reasons and did not show that the cantonal pleading had already satisfied the required substantiation.

Questão jurídica principal

Court costs and party compensation in the complaint proceedings

Decisão extraída

The complaint proceedings are in principle free of charge and no party compensation is awarded.

Fundamentação extraída

Art. 20a(1) SchKG makes the proceedings cost-free, and Art. 62(2) GebV SchKG excludes party compensation.
