The Federal Supreme Court held that the defendant’s appeal against the cantonal decision annulling the prosecutor’s discontinuance and remitting the case was inadmissible. The challenged decision was a remittal order and therefore not a final decision under Art. 90 BGG; no exception under Art. 93(1) BGG was invoked. The court also refused the later request for legal aid because the appeal lacked prospects of success. Court costs of CHF 500 were charged to the appellant, taking account of his financial situation.

A cantonal decision that annuls a discontinuance and remits the matter to the prosecutor for continuation does not finally conclude the proceedings and is therefore not directly appealable in ordinary federal appeal proceedings. Such a decision is only reviewable if one of the statutory exceptions for preliminary or incidental decisions is demonstrated. Where the appeal is manifestly inadmissible or devoid of prospects of success, legal aid must be refused under Art. 64 BGG; court costs are allocated to the unsuccessful appellant with due regard to financial circumstances (Art. 65 Abs. 2 and Art. 66 Abs. 1 BGG).

Beschwerde gegen das Urteil des Obergerichts des Kantons Solothurn, Beschwerdekammer, vom 4. November 2010.

Der Präsident zieht in Erwägung:

Die Staatsanwaltschaft des Kantons Solothurn stellte am 2. Juni 2010 eine Strafuntersuchung gegen den Beschwerdeführer wegen Drohung ein. Dagegen führte die Beschwerdegegnerin 2 kantonale Beschwerde. Die Vorinstanz hob den Entscheid der Staatsanwaltschaft in Gutheissung der Beschwerde am 4. November 2010 auf. Die Akten gingen zur Fortsetzung des Verfahrens zurück an die Staatsanwaltschaft. Dagegen wendet sich der Beschwerdeführer ans Bundesgericht.

Eine Beschwerde ans Bundesgericht ist nur zulässig gegen Entscheide, die das Verfahren abschliessen (Art. 90 BGG). Im angefochtenen Entscheid wurde die Sache zur Fortsetzung des Verfahrens an die Staatsanwaltschaft zurückgewiesen. Das Verfahren ist somit noch nicht abgeschlossen. Dass einer der Ausnahmefälle von Art. 93 Abs. 1 BGG vorläge, macht der Beschwerdeführer zu Recht nicht geltend. Auf die Beschwerde ist im Verfahren nach Art. 108 BGG nicht einzutreten.

Die Gerichtskosten sind dem Beschwerdeführer aufzuerlegen (Art. 66 Abs. 1 BGG). Das nachträglich gestellte Gesuch um unentgeltliche Rechtspflege ist in Anwendung von Art. 64 BGG abzuweisen, weil die Rechtsbegehren aussichtslos erschienen. Der finanziellen Lage des Beschwerdeführers ist bei der Bemessung der Gerichtsgebühr Rechnung zu tragen (Art. 65 Abs. 2 BGG). Der Beschwerdegegnerin 2 ist keine Entschädigung auszurichten, weil sie vor Bundesgericht keine Umtriebe hatte.
Demnach erkennt der Präsident:

Auf die Beschwerde wird nicht eingetreten.

2.
Das Gesuch um unentgeltliche Rechtspflege wird abgewiesen.

3.
Die Gerichtskosten von Fr. 500.-- werden dem Beschwerdeführer auferlegt.

4.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Solothurn, Beschwerdekammer, schriftlich mitgeteilt.
