Resumo Omnilex

The Federal Supreme Court held that the appellant lacked standing under Art. 81(1) LTF because he had not taken part in the cantonal proceedings and did not otherwise show a legal interest. The criminal appeal was therefore declared inadmissible in simplified procedure under Art. 108(1)(a) LTF. As the appeal had no chance of success, the request for legal aid was denied. Court costs of CHF 500 were imposed on the appellant, taking his financial situation into account.

Sumário Omnilex

Art. 81 al. 1 LTF; Art. 108 al. 1 let. a LTF; standing to appeal in criminal matters before the Federal Supreme Court requires prior participation in the cantonal proceedings or a deprivation of the opportunity to participate, together with a legally protected interest in annulment or modification of the contested decision. Where these conditions are not met, the appeal is inadmissible in simplified procedure. A manifestly inadmissible appeal lacks prospects of success and excludes legal aid under Art. 64 al. 1 LTF; costs are borne by the appellant under Art. 66 al. 1 LTF, with regard had to financial circumstances (consid. 2-3).

Ministère public central du canton de Vaud,
intimé.

Objet

He lacked standing because he did not participate in the cantonal proceedings and did not establish a legal interest in the annulment or modification of the challenged decision.

Under Art. 81(1) LTF, standing requires participation in the previous instance or deprivation of the possibility to participate, together with a legal interest. This requirement was not met, so the appeal was inadmissible under the simplified procedure of Art. 108(1)(a) LTF.

Legal aid was denied because the appeal had no prospects of success.

Since the appeal was manifestly inadmissible, the request for legal aid failed under Art. 64(1) LTF.

The appellant must pay court costs, fixed at CHF 500, taking into account his financial situation.

Costs follow the outcome under Art. 66(1) LTF, with the amount adjusted to the appellant's financial circumstances.
