Resumo Omnilex

X.________ challenged the cantonal judgment concerning conversion of his community-service sentence into a custodial sentence. The Federal Supreme Court held that he had no legally protected interest in annulment or modification because the cantonal court had already refused the conversion he opposed. The criminal appeal was therefore manifestly inadmissible under Art. 108 al. 1 let. a LTF. In view of this outcome, the Court exceptionally waived judicial costs.

Sumário Omnilex

Art. 81 LTF; admissibility of a criminal appeal requires a legally protected interest in the annulment or modification of the challenged decision. A party lacks standing where the cantonal decision is already favorable on the point contested before the Federal Supreme Court. Manifest inadmissibility may be dealt with summarily under Art. 108 al. 1 let. a LTF. Where the appeal is inadmissible, the court may exceptionally refrain from charging judicial costs (consid. 1-2).

Cour de droit pénal

Composition
M. le Juge Schneider, Juge unique.
Greffier: M. Oulevey.

Parties
X.________,
recourant,

contre

Ministère public du canton de Vaud, 1014 Lausanne,
intimé.

Objet

Whether the criminal appeal was admissible under Art. 81 LTF despite the appellant's lack of a legally protected interest in changing the cantonal judgment.

Decisão extraída

The appellant had no interest in annulment or amendment because the cantonal judgment already refused conversion of the community-service sentence into custody; the appeal was therefore inadmissible.

Fundamentação extraída

Under Art. 81 LTF, only a party with an interest in annulment or modification may appeal in criminal matters. Since the decision challenged was favorable to the appellant on the only point he raised, he lacked the requisite interest.

Questão jurídica principal

Whether court costs should be charged despite inadmissibility of the appeal.

Decisão extraída

Court costs were exceptionally waived.

Fundamentação extraída

The judge exceptionally decided not to collect judicial costs.
