The Federal Supreme Court did not enter into a criminal appeal against a Zurich High Court judgment because the filing was signed by a non-lawyer representative despite a cure notice requiring proper signature, and because the challenged judgment was not submitted. A power of attorney or an indication that the filing is made "i.A." does not substitute for the appellant's own valid signature where the representative lacks authority. If the appellant also fails to submit the challenged decision after an express request, this constitutes an additional ground for non-entry. Unnecessary costs are borne by the person who caused them (Art. 66 Abs. 3 BGG).

Beschwerde gegen das Urteil des Obergerichts des Kantons Zürich, I. Strafkammer, vom 3. Juni 2009 (SB090172/U/jv).
Der Einzelrichter zieht in Erwägung:

In Strafsachen können Parteien vor Bundesgericht nur von Anwälten und Anwältinnen vertreten werden (Art. 40 Abs. 1 BGG). Der Vertreter des Beschwerdeführers ist nicht Anwalt. In Anwendung von Art. 42 Abs. 5 BGG wurde ihm deshalb mit Schreiben vom 17. September 2009, von dem eine Kopie an den Beschwerdeführer persönlich ging, eine Frist bis 28. September 2009 angesetzt, um den Mangel zu beheben, ansonsten die Rechtsschrift unbeachtet bliebe (act. 2). Der Mangel wurde nicht behoben, denn die Eingabe vom 26. September 2009 wurde erneut vom Vertreter des Beschwerdeführers unterschrieben (act. 4). Dass er nun eine Vollmacht des Beschwerdeführers einreichte (act. 3) und die Beschwerde "i.A." des Beschwerdeführers unterschrieb, ändert nichts daran, dass er nicht zur Vertretung des Beschwerdeführers und damit nicht befugt ist, eine Beschwerde in Strafsachen zu unterschreiben. Dies kann nur der Beschwerdeführer persönlich tun. Dieser hat auf die Kopie des bundesgerichtlichen Schreibens indessen nicht reagiert. Androhungsgemäss ist auf die Beschwerde im Verfahren nach Art. 108 BGG nicht einzutreten.

Im Übrigen ist auf die Beschwerde noch aus einem anderen Grund nicht einzutreten. Im Schreiben vom 17. September 2009 wurde der Vertreter des Beschwerdeführers in Anwendung von Art. 42 Abs. 3 BGG zusätzlich aufgefordert, den angefochtenen Entscheid nachzureichen, ansonsten die Rechtsschrift unbeachtet bliebe (Art. 42 Abs. 5 BGG). Auch dieser Aufforderung ist der Vertreter des Beschwerdeführers nicht nachgekommen.

Unnötige Kosten hat zu bezahlen, wer sie verursacht (Art. 66 Abs. 3 BGG). Im vorliegenden Fall wurden die unnötigen Kosten des Verfahrens durch den Vertreter des Beschwerdeführers verursacht. Diesem sind folglich die Gerichtskosten aufzuerlegen.
Demnach erkennt der Einzelrichter:

Auf die Beschwerde wird nicht eingetreten.

Die Gerichtskosten von Fr. 800.-- werden dem Vertreter des Beschwerdeführers auferlegt.

3.
Dieses Urteil wird dem Beschwerdeführer persönlich, dem Vertreter des Beschwerdeführers, der Oberstaatsanwaltschaft des Kantons Zürich und dem Obergericht des Kantons Zürich, I. Strafkammer, schriftlich mitgeteilt.
