Resumo Omnilex

The Federal Supreme Court dismissed the defendant's appeal against an Aargau cantonal judgment convicting him of repeated facilitation of unlawful stay and repeated employment of foreign women without authorization. It found no federal-law violation in the cantonal reasoning, and any possible deficiency in the appeal's motivation was left open. The court also denied free legal aid because the appeal lacked prospects of success and imposed reduced court costs of CHF 800 on the appellant.

Sumário Omnilex

Art. 42 Abs. 2, Art. 64, Art. 65 Abs. 2, Art. 66 Abs. 1 and Art. 109 BGG; summary dismissal of an inadequately reasoned criminal appeal and denial of legal aid. The Federal Supreme Court may leave open whether the reasoning requirements are met if the appeal is clearly unfounded. Where the cantonal judgment addresses all raised objections and the appellant fails to identify any violation of federal law, the appeal is dismissed in summary proceedings under Art. 109 BGG. Legal aid is refused when the request is manifestly hopeless. Court costs are borne by the unsuccessful appellant, with due regard to financial circumstances in fixing the fee.

Urteil vom 26. Oktober 2009

Besetzung

Bundesrichter Ferrari, Mathys,
Gerichtsschreiber Monn.

Parteien

Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Aargau, 5001 Aarau,
Beschwerdegegnerin.

Gegenstand

Kammer, vom 15. Juni 2009 (SST.2009.39 / ch / nl).
Das Bundesgericht zieht in Erwägung:

1.

4.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Aargau, Strafgericht, 2. Kammer, schriftlich mitgeteilt.
