Resumo Omnilex

X.________ challenged the Basel-Landschaft decision refusing to open criminal proceedings for property offences. The Federal Supreme Court held that he lacked standing under Art. 81 BGG because he was neither a private prosecutor nor a victim, and the case did not concern the right to file a criminal complaint. The Court also noted that the complaint would in any event have been insufficiently reasoned. It therefore did not enter into the complaint, denied free legal aid as hopeless, and imposed reduced court costs of CHF 500 on the appellant.

Sumário Omnilex

Art. 81 Abs. 1 lit. b Ziff. 4–6 BGG, Art. 108 BGG; standing to file a criminal complaint before the Federal Supreme Court. A complainant who is neither a private prosecutor nor a victim lacks standing to challenge a refusal to open criminal proceedings when the cantonal decision was also served on the public prosecutor, who could itself appeal. The alternative gateways of Art. 81(1)(b) nos. 5 and 6 BGG are not satisfied absent a victim status or a challenge to the criminal-complaint right as such. Where standing is lacking, the Court may decline to enter under the summary procedure; a submission consisting only of appellatory criticism does not meet the federal reasoning requirements (consid. 2). Free legal aid is refused if the complaint is manifestly hopeless (Art. 64 BGG).

Urteil vom 24. November 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Basel-Landschaft, Bahnhofplatz 3a, 4410 Liestal,
Beschwerdegegnerin.

Gegenstand

Whether the federal criminal complaint was admissible despite possible late filing.

Decisão extraída

The timeliness question was left open because the complaint was inadmissible in any event.

Fundamentação extraída

The court did not decide the deadline issue, since the appellant lacked standing to appeal.

Questão jurídica principal

Whether the appellant had standing under Art. 81 BGG to challenge the refusal to open criminal proceedings.

Decisão extraída

He lacked standing because he was neither a private prosecutor, nor a victim, and the issue did not concern the right to file a criminal complaint itself.

Fundamentação extraída

Because the cantonal first-instance decision was also served on the public prosecutor, which could have appealed, the appellant was not a private prosecutor within Art. 81(1)(b)(4) BGG; the requirements of nos. 5 and 6 were also not met.

Questão jurídica principal

Whether the complaint satisfied the federal reasoning requirements.

Decisão extraída

The court indicated it would also have failed for insufficient reasoning, as it amounted to impermissible appellatory criticism.

Fundamentação extraída

The submission merely contested the allegedly affected legal interest in a manner that did not meet the Federal Supreme Court’s reasoning standards.

Questão jurídica principal

Whether legal aid should be granted.

Decisão extraída

Legal aid was denied because the appeal was hopeless.

Fundamentação extraída

Under Art. 64 BGG, a request must be refused when the relief sought has no prospects of success.
