Resumo Omnilex

The Federal Supreme Court refused to consider the appellant's criminal complaint against a Thurgau cantonal judgment convicting her of disobeying an official order concerning her son's school attendance. The Court held that the filing did not satisfy the substantiation requirement of Art. 42(2) BGG because it merely repeated her version of events and did not engage with the decisive cantonal findings. The request for free legal aid was rejected as hopeless, and costs of CHF 500 were imposed on the appellant.

Sumário Omnilex

Art. 42 Abs. 2 BGG; substantiation of a federal complaint in criminal matters: the pleadings must, in concise form and with reference to the challenged judgment, show in what respect the decision violates law. A merely appellatory recital of one's own view of the facts is insufficient. The appellant must address the decisive factual findings and legal reasoning of the cantonal instance; failure to do so leads to non-entry under Art. 108 BGG (consid. 1). Where the complaint is manifestly hopeless, legal aid is to be refused under Art. 64 BGG. Court costs are allocated according to Art. 66 Abs. 1 BGG, with due regard to the party's financial circumstances under Art. 65 Abs. 2 BGG (consid. 2).

Urteil vom 26. Juli 2013

Strafrechtliche Abteilung

Besetzung
Bundesrichter Mathys, Präsident,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführerin,

gegen

Generalstaatsanwaltschaft des Kantons Thurgau, Zürcherstrasse 323, 8510 Frauenfeld,
Beschwerdegegnerin.

Gegenstand

Whether the criminal appeal met the Federal Supreme Court's reasoning requirements under Art. 42(2) BGG.

Decisão extraída

The appeal did not sufficiently engage with the cantonal court's reasoning and was therefore not admissible for substantive review.

Fundamentação extraída

The brief must explain, with reference to the challenged decision, how it violates the law. The filing merely restated the appellant's view of the facts and failed to address the decisive findings of the lower court, including that she could have contacted her son by mobile phone and urged him to attend school.

Questão jurídica principal

Whether the appellant was entitled to free legal aid.

Decisão extraída

Free legal aid was denied because the appeal had no prospect of success.

Fundamentação extraída

Since the appeal was not admitted due to insufficient reasoning, the requests were manifestly hopeless within the meaning of Art. 64 BGG.

Questão jurídica principal

Allocation of federal court costs.

Decisão extraída

Court costs were imposed on the appellant, taking her financial situation into account.

Fundamentação extraída

As the appeal failed, costs followed the outcome under Art. 66(1) BGG; the amount was moderated in light of the appellant's financial circumstances under Art. 65(2) BGG.
